A new judge will be required to oversee the case as a result of Justice Liman’s elevation to the Court of Appeal, which prompted this transfer. The case in question concerns the Kano House of Assembly’s repeal of the Kano Emirate Council (Amendment No. 2) law, which led to Aminu Ado Bayero’s overthrow as Kano’s emir.
The law was put into effect by Governor Abba Kabir Yusuf, who also oversaw the establishment of four new emirates: Bichi, Rano, Karaye, and Gaya. In accordance with this law, the emirs that former governor Dr. Abdullahi Umar Ganduje had appointed were also removed from office.
Furthermore, after Ganduje deposed Muhammadu Sanusi II as the Emir of Kano in 2020, the law was used to reinstate him. In his decision, Justice Liman declared Sanusi’s appointment as emir to be void and overturned the state government’s repeal of the Kano Emirates Council Law.
He stressed that a court order prohibiting the government from acting in accordance with the new emirate council law had been disregarded by them. Concerned that the government’s disrespect for the court order could push the country toward anarchy, Justice Liman expressed worry over the government’s disdain for the ruling.
The judge made it quite evident that the defendants were aware of the court’s interim order, but they chose to disregard it and carry out the law’s implementation in any case. In response, Justice Liman affirmed his right to enforce adherence to his ruling and gave everyone concerned instructions to keep things as they are until further orders are given.
