Siminalayi Fubara, the governor of Rivers State, has come under fire from Nyesom Wike, the minister of the Federal Capital Territory, for his ignorance of the law. He identified that the State Assembly is challenging the governor’s unconstitutional spending of public funds without a budgetary allocation. He stressed that the assembly had only stated at the Federal High Court that the Central Bank Accountant General should not continue to release funds without a budgetary provision, as this would be a violation of financial regulations. He questioned the feasibility of seeking legal redress in the State High Court, given that the Central Bank is a federal government agency and not subject to the jurisdiction of the state court.

He said in a live coverage by TVC, ‘I take exception to a man [Fubara] who is an illiterate in the law. We never knew he was an illiterate in the law. He said anything that deals with the State must come to the State High Court, what a shame. If you don’t know anything, just say you don’t know anything. The State Assembly is challenging an elected government that you have no right to be spending money without a budget. Therefore, Central Bank Accountant General, you cannot continue to release funds when the fund is not being budgeted. Can you sue such a matter at the State High Court when the Central Bank is a Federal government agency?
