It should be recalled that following the murder of the 17 soldiers in Okuama, the Nigerian Army had declared 8 persons wanted in connection with the murder, and HRM Clement Ikolo was one of the 8 suspects declared wanted.
King Ikolo had submitted himself to the Police for questioning, but the Police had handed him over to the Army.
During the recent interview, Enwelizor said that the Army should allow the Police to investigate the issue and bring anyone found guilty to justice.
He said that the Constitution of Nigeria does not give power to the Army to declare any citizen wanted, neither does not the Constitution empower the Army to arrest and prosecute anybody.
He added, “It is not their responsibility. It is only in Nigeria that you see the Army doing everything, and this is not good for our constitution.
“The Army should refrain from committing a constitutional breach by declaring citizens wanted for criminal offences. It is only the Police that has the constitutional right to arrest, prosecute, and or declare anybody wanted and not the Army.”
He said that if there is any dispute anywhere, the Police have the right to wade in and address the issue, and not the Army.
Speaking further, he said that in some countries, the Army cannot be seen on the streets, because their duty is to protect the territorial integrity of the country and not declaring people wanted.
